OREM, Utah–(CCNMatthews – Dec 9, 2005) –

Xactware Inc. announced that its patent infringement dispute with Symbility Solutions Inc., a Canadian company, will move forward in Michigan. Xactware sued Symbility in a Utah federal court for infringement of Xactware’s patented property estimation technology, unfair competition, and copyright infringement. Symbility responded by disputing the Utah court’s jurisdiction, filing its own countersuit in Michigan on the same issues. In a recent ruling, the Utah court found that Symbility lacked a sufficient connection to Utah for the dispute to be resolved in that forum. As a result, Xactware’s claims against Symbility will be addressed in Michigan, where Xactware will seek a preliminary injunction to bar Symbility from continuing to infringe Xactware’s patent rights pending a full trial on the merits.

Brad Jackman, executive vice president of Xactware, stated, “We are pleased that we will finally begin to reach the merits of our claims against Symbility. We have very clear goals in mind regarding this lawsuit; protect our intellectual property and protect the clients who trust us with their business. That includes the patents in question.” Jackman continued, saying, “We have patented technologies in our software to provide our clients with superior technology and service, so when we believe our intellectual property rights are being violated, that is a disservice to us, and our clients, and we must take appropriate action.”
