WATERLOO, ONTARIO–(CCNMatthews – Dec. 7, 2005) – Symbility Solutions Inc. (www.symbilitysolutions.com), a wholly owned subsidiary of Automated Benefits Corp. (TSX VENTURE:AUT), advises that the United States District Court for the Central District of Utah has dismissed a patent infringement lawsuit filed against the company this past summer by Xactware, Inc.
“Symbility is pleased with the court’s decision to dismiss this lawsuit, and we are moving ahead with our efforts to market the Symbility mobile claims software solution to U.S.-based property insurance providers, adjusters, contractors and other stakeholders,” said James Swayze, chief executive officer, Automated Benefits Corp. “At Symbility, our customers will always be our number one priority and we look forward to providing the same superior solution and service to our U.S. customers as we have done in Canada with Economical, Gore Mutual and Allstate.”
Following the filing of the Utah action by Xactware, Symbility filed a complaint in the United States District Court for the Eastern District of Michigan seeking a declaratory judgment that certain Xactware patents are invalid, unenforceable, or not infringed by Symbility, and that action remains pending. Following the dismissal of Xactware’s Utah action, Symbility has added to its Michigan action claims against Xactware for malicious prosecution, abuse of process, and violation of United States antitrust law.
Available for any mobile-enabled, pen-based handheld platform, the Symbility Solutions system allows adjusters and contractors to write and process claims on-site with greater accuracy and to settle claims faster. The core of the solution is Symbility.NET, a software platform that is an Internet-based communications hub, data warehouse and analytics engine. Symbility.NET allows claim participants to access all information related to every claim they’ve ever participated in, from any computer with an Internet connection. It also provides very powerful analytics tools to mine the extensive data collected with each claim and create various graphical and tabular reports, as well as search for specific claims based on numerous criteria.
