TORONTO, ONTARIO–(CCNMatthews – Dec. 30, 2005) – Automated Benefits Corp. (TSX VENTURE:AUT) (the “Corporation”) advises that on December 29, 2005, Xactware, Inc. filed its answer to the complaint brought against it in the Eastern District of Michigan by the Corporation’s wholly owned subsidiary, Symbility Solutions Inc. Xactware denied all substantive allegations against it, and asserted counterclaims for patent infringement, copyright infringement, and unfair competition. Xactware further indicated that it would be filing a motion for preliminary injunction with respect to certain of its patent counterclaims, and a motion to dismiss Symbility’s common law tort claims.
Symbility believes that its claims against Xactware are meritorious, and that it has substantial defenses to all of Xactware’s claims. It remains Symbility’s objective to resolve its disputes with Xactware as promptly and comprehensively as possible, to minimize any possible inconvenience to customers.
